Ohio Constitution Law and History Website—Enhancements & Updates

There have been some enhancements and updates to the Ohio Constitution Law and History website, see link, that should be of interest to those who follow the Ohio Constitution.

Cases to Watch. This feature, Cases to Watch, see link, reports on cases in the lower courts of Ohio involving state constitutional issues. It has been updated as of August 1, 2024.  Highlights, which are in bold, report on developments during the last month.

Court Decisions. This feature, Court Decisions, see link, has been updated to include summaries of 5 cases decided by the Ohio Supreme Court in July 2024.

Ohio Supreme Court Pipeline. The Ohio Supreme Court Pipeline, see link, is a table of cases that the court has agreed to hear that involve state constitutional issues and, in some cases, original actions.  It has been updated as of August 1, 2024. 

Enhancements—Direct Democracy. Two new items that were part of the 1912 direct democracy amendment to the Ohio Constitution are now on the website. Most public attention has focused on the constitutional initiative, but the amendment also included a statutory initiative and a referendum. The Ohio Statutory Initiative, see link, which has been rarely used, permits electors to propose laws that can go to the ballot ff the General Assembly does not adopt them. The Ohio Referendum, see link,  which has been used more frequently, permits electors by the General Assembly. The statutory initiative and the referendum are discussed in more detail on the website and can also be found by going to the drop-down menu under the Constitutional Revision menu. see link
